TERMS AND CONDITIONS

Welcome to profoundarmory.com (the “Website”). This Website is owned and operated by Profound Armory LLC (“Profound Armory,” “Company,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms,” “Terms and Conditions,” or “Agreement”) govern your access to and use of the Website and any information, products, services, features, content, tools, and resources made available through the Website (collectively, the “Services”).

By accessing, browsing, creating an account on, placing an order through, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Website or Services.

We reserve the right to modify these Terms at any time. Any revised Terms will become effective when posted on the Website unless otherwise stated. Your continued use of the Website after revised Terms are posted constitutes your acceptance of those revisions to the extent permitted by applicable law.

1. ELIGIBILITY AND LAWFUL USE

You may use the Website and Services only for lawful purposes and in accordance with these Terms.

By using the Website or placing an order, you represent and warrant that:

  1. You have the legal capacity to enter into a binding agreement;

  2. You meet all applicable federal, state, and local age requirements for any product you seek to purchase, possess, receive, or use;

  3. You are not prohibited by applicable law from purchasing, possessing, receiving, owning, or using the products you order;

  4. All information you provide to Profound Armory LLC is truthful, accurate, complete, and current;

  5. You will not use the Website, Services, or any products purchased from us for an unlawful purpose; and

  6. You are solely responsible for determining and complying with all laws applicable to you and your location.

We reserve the right to refuse service, reject or cancel an order, restrict access, request additional documentation, or terminate an account when we reasonably believe a transaction or activity may violate applicable law, these Terms, our policies, or the requirements of a manufacturer, distributor, payment provider, carrier, or other service provider.

2. FIREARMS, AMMUNITION, ACCESSORIES, AND REGULATED PRODUCTS

Profound Armory LLC may offer firearms, ammunition, firearm components, magazines, accessories, optics, knives, tactical products, and other items that may be regulated differently depending on the purchaser’s jurisdiction.

You are solely responsible for knowing and complying with all federal, state, county, municipal, and local laws, regulations, ordinances, restrictions, licensing requirements, registration requirements, age requirements, possession restrictions, transfer requirements, and ownership requirements applicable to any product you purchase or attempt to purchase.

Laws concerning firearms and related products can change frequently and may differ substantially between jurisdictions. The presence of a product on the Website does not constitute a representation, warranty, or guarantee that the product is lawful to purchase, ship, receive, possess, install, configure, carry, transfer, or use in your jurisdiction.

Profound Armory LLC reserves the right, in its sole discretion and to the extent permitted by law, to:

  • Refuse or cancel any transaction;

  • Decline to ship any product to any jurisdiction;

  • Require proof of age, identity, residency, licensing, eligibility, or other documentation;

  • Require shipment to a properly licensed Federal Firearms Licensee (“FFL”);

  • Require additional compliance review before processing or shipping an order;

  • Restrict quantities;

  • Decline transactions involving products we believe may be prohibited or restricted; and

  • Cancel orders based on changes in law, regulatory guidance, legal uncertainty, carrier restrictions, distributor restrictions, or compliance concerns.

You agree that you will not purchase any product for another person in violation of law, engage in a straw purchase, provide false or misleading information, evade a legal restriction, or use the Website to facilitate unlawful conduct.

3. FIREARM TRANSFERS AND FFL REQUIREMENTS

Where required by law, firearms must be shipped to a valid and appropriately licensed FFL and transferred in accordance with applicable law.

The purchaser is responsible for:

  1. Selecting an eligible receiving FFL;

  2. Confirming that the receiving FFL is willing and legally able to accept the transfer;

  3. Providing accurate FFL information;

  4. Completing all legally required forms, background checks, waiting periods, identification requirements, permits, certifications, and transfer procedures;

  5. Paying any transfer fees, storage fees, background-check fees, taxes, or other charges imposed by the receiving FFL or government authority; and

  6. Ensuring that the firearm is legal in the purchaser’s jurisdiction before placing the order.

An order confirmation does not guarantee that a firearm will be transferred to you. Final transfer eligibility may depend on background checks, documentation, government approval, the receiving FFL, and other legal requirements.

If a firearm cannot be transferred to you, any return, cancellation, restocking, shipping, handling, or other charges will be governed by our applicable return and cancellation policies and by law.

  13. Use the Website to facilitate an unlawful firearm transfer or other unlawful transaction; or

  14. Engage in conduct that could damage Profound Armory LLC, our customers, service providers, or third parties.

Unauthorized use may result in account termination, order cancellation, civil liability, criminal liability, and referral to appropriate authorities when legally appropriate.

8. ORDERS AND ACCEPTANCE

  • Inventory errors;

  • Promotional errors;

If a product is mistakenly listed at an incorrect price, we may refuse or cancel the affected order to the extent permitted by law, including after an order confirmation has been issued.

If payment has already been collected for an order that we cancel, we will provide the appropriate refund or credit as required by applicable law and our payment-processing procedures.

Product images are illustrative and may differ from the actual product due to manufacturer changes, production variations, screen settings, packaging revisions, or other factors.

10. PAYMENT AND FRAUD PREVENTION

You represent and warrant that you are authorized to use any payment method submitted in connection with an order.

We may use third-party payment processors and fraud-prevention services. Transactions may be delayed, held, reviewed, declined, or canceled when suspicious activity, mismatched information, elevated fraud risk, legal concerns, or payment issues are identified.

You agree not to initiate a fraudulent or abusive chargeback. Nothing in this provision limits any legitimate rights you may have under applicable consumer-protection or payment-card laws.

Certain products may require adult signature, identification, FFL delivery, special handling, or other restrictions.

You are responsible for providing accurate shipping information. Additional charges caused by incorrect or incomplete information may be your responsibility to the extent permitted by law.

13. PRODUCT SAFETY AND ASSUMPTION OF RISK

  • Confirming product compatibility;

  • Ensuring proper installation;

Do not use any product unless you understand how to do so safely and lawfully. When appropriate, installation, inspection, repair, or modification should be performed by a qualified professional or competent gunsmith.

To the fullest extent permitted by law, you assume the risks inherent in the possession and lawful use of products purchased through the Website, except to the extent liability cannot legally be waived or limited.

14. PRODUCT COMPATIBILITY

You are responsible for verifying that any component, accessory, ammunition, optic, mount, magazine, part, or other product is compatible with your firearm, equipment, or intended application before installation or use.

Product descriptions and compatibility information may be based on manufacturer or third-party information. We do not guarantee compatibility unless expressly stated in writing.

Improper installation or use may cause malfunction, damage, injury, or death. Consult the manufacturer or a qualified professional when uncertain.
